Citizens Risk Arrest to Halt Operations at Richmond Oil Train Terminal: Call on Air Quality Agency to Reverse Illegal Permit, Protect Public Health

[Richmond, CA] Today more than a dozen Bay Area citizens chained themselves to a gate at the Kinder Morgan rail terminal in Richmond to stop operations. The citizens risked arrest to protest mile-long oil trains that threaten the safety of area residents and are a massive new source of air and carbon pollution in the region.

Among the demonstrators were residents of Richmond, Rodeo, Martinez, and Benicia, all towns that currently see dangerous oil trains moving through residential areas. Earlier this year the regional air quality agency, known as the Bay Area Air Quality Management District, changed an existing permit to allow oil trains at the rail facility. Demonstrators contend that the agency broke the law when it modified the existing permit without additional environmental and safety review.

On Friday the San Francisco Superior Court will hold a hearing on a lawsuit filed by groups challenging the legality of the permit change and asking for a halt to oil train operations at the facility.

“I work with Richmond residents who already struggle with cancer, asthma and other devastating health impacts of pollution. Now they are living with bomb-trains full of explosive Bakken crude oil driving through their neighborhoods. By allowing this to happen, BAAQMD is failing to protect us and choosing Kinder Morgan’s profits over our safety,” said Megan Zapanta, Asian Pacific Environmental Network Richmond Community Organizer.

“People in Richmond are angry that the Air District, who are supposed to protect us, instead has put our community at catastrophic risk along with all the uprail communities. This irresponsible behavior must be stopped NOW!” said Andres Soto, organizer with Communities for a Better Environment.

“It’s unacceptable and illegal that the Air District allowed Kinder Morgan to bring explosive Bakken oil by rail from North Dakota without going through the processes established by state law to protect air quality and the safety of families in Pittsburg, Martinez, Crockett, Rodeo, Benicia, and Richmond. We demand that all operations related to oil by rail at Kinder Morgan stop immediately,” says Pamela Arauz, on behalf of Bay Area Refinery Corridor Coalition.

“The law in the State of California requires public agencies like the Air District to inform the public of projects like the Kinder Morgan Bomb Train operation.  Not only that, the law requires an environmental review and public input into the process of issuing permits.  The Air District broke the law when they secretly approved this dangerous project,” stated Denny Larson of Global Community Monitor.

“As the Bay Area Air District and other government agencies are failing to protect the health and lives of communities from the reckless shipments of crude oil by rail, the people are taking action to protect our communities,” said Bradley Angel, Executive Director of Greenaction for Health and Environmental Justice.

“The Air District took a reckless, illegal shortcut that puts our families at risk. We’ve seen what happens when one of these trains derails and catches fire, we can’t let that happen here,” said Ethan Buckner, US organizer with ForestEthics.

“Climate disruption is bearing down on us even faster because of the extreme extraction of tar sands and shale oil. With Bomb Trains carrying millions of gallons of that dangerous crude rolling on Bay Area rails, all of our lives are on the line. Instead of the alarming dead-end expansion of the fossil fuel industry we need a rapid transition to renewable energy now,” said Shoshana Wechsler of the Sunflower Alliance.

“To be sure, we take the oil refineries’ contempt for fenceline communities for granted. But frankly, it was shocking to see how covertly BAAQMD threw our public health under the bus,” said Nancy Rieser, Co-founder, Crockett-Rodeo United to Defend the Environment (C.R.U.D.E.)

Banner Suspended Above Downtown Roanoke, Calls On Billionaire To Clean Up His Act

National groups call on Jim Justice to pay for his plunder

Roanoke, VA – Early this morning members of Mountain Justice, Rising Tide North America and Radical Action for Mountain and People’s Survival (RAMPS) hung a banner, suspended between two downtown buildings on Jefferson street in Roanoke. The groups are acting in support of community demands in Virginia, Kentucky, West Virginia and Tennessee that billionaire coal baron Jim Justice stop poisoning water, exposing communities to devastating mountaintop removal coal mining operations and leaving central Appalachia a public health disaster. The banner reads; “Jim Justice Profits, Appalachia Pays.” and “Jim Justice, Toxic Spill Billionaire”.

The activists hanging the banner are with Mountain Justice, a regional group committed to an end of Mountaintop Removal and a just economic transition for Appalachia. They are joined by RAMPS, based in West Virginia, and Rising Tide North America, an international network of grassroots groups focused on stopping climate change.

Erin Mckelvy, of Lee County Virginia and a member of Mountain Justice spoke to reporters on the scene, “ There’s a lot of people out of work across the coalfields today, in part because of the bad business planning done by people like Jim Justice. Justice has the means to properly clean up these sites, and we think Justice’s part in destroying Appalachia’s mountains needs to end yesterday. How much more does one person need? Appalachia needs a new path forward, and Jim Justice should join us, or get out of the way.”

D. Steele, with RAMPS in West Virginia said: “I’m taking this action today to keep the bright light shining on Jim Justice and the ways that his coal mining operations hurt communities. From damaged house foundations to poisoned streams, violated permits to unpaid workers, billionaire coal operator Jim Justice is making millions from the exploitation of Appalachia’s people, forests, and mountains. He needs to clean up his act now, and commit to giving back to the communities that have given him so much.”

Today’s action comes after weeks of bad news for the Justice Group and Roanoke-based Southern Coal. From $9.9 million in new bonding fees, and fines of over a million dollars in Kentucky, to cessation orders in Tennessee and bond forfeitures in Virginia, Justice’s corner-cutting practices across the region show that community concerns are grounded in reality. Mountain Justice and allies call on people to support the groups most impacted by Jim Justice, like the Southern Appalachian Mountain Stewards in Virginia, in their push to hold the billionaire responsible for the damage he’s caused.

Today’s action is part of a long tradition of non-violent civil disobedience addressing social justice and environmental issues. Like in the civil rights era and movements to stop the destruction of forests, oceans and the climate, regulatory and political solutions to stopping mountaintop removal have proven ineffective and people working to stop the destruction of Appalachia’s Mountains have taken the next logical step in confronting coal barons like Jim Justice.

Seattle Activists Mount Tripod – Stop Exploding Oil Trains

Five residents of Seattle and Everett, WA, working with Rising Tide Seattle, have stopped work at a Burlington Northern Santa-Fe Rail Yard in Everett by erecting a tripod-structure on the outbound railroad tracks, directly in front of a mile-long oil train. Seattle resident Abby Brockway – a small business owner, and mother – is suspended from the structure 18 feet above the tracks while four other residents are locked to the legs the tripod. The group is demanding an immediate halt to all shipments of fossil fuels through the Northwest and calling on Governor Inslee to reject permits for all new fossil fuel projects in Washington, including proposed coal and oil terminals.

“People in the Pacific Northwest are forming a thin green line that will keep oil, coal and gas in the ground,” said Brockway, “Just one of these proposed terminals would process enough carbon to push us past the global warming tipping point – we won’t let that happen.”

Today’s protest has shut down work at BNSF’s Delta Rail Yard in Everett. With the increase of fossil fuel transport in recent years the yard has become a crucial staging ground for coal trains headed to Canadian export terminals and oil trains bound for Washington refineries. An oil-train carrying explosive bakken crude oil sat stalled while the protest continued.

“Exploding oil-trains running through my town are just a reminder of how out of control the fossil fuel industry really is,” said Jackie Minchew an Everett resident and retired educator locked to one of the tripod’s poles.

In a controversial move, Burlington Northern Santa-Fe recently announced a tentative deal with Union leaders to reduce train crews from an engineer and conductor to a single engineer. The oil train that de-railed and exploded in Lac-Megantic, Quebec was crewed by a single engineer. BNSF claims that oil-trains will continue to have two person crews, but critics point out that nothing in the proposed contract binds the company to that statement. Under the proposed deal Coal Trains would be operated by a single crew-member.

“BNSF is endangering workers, communities and our environment. They should keep the conductors and lose the oil trains,” said Brockway.

The surge in oil-train traffic is already impacting other commodities like passenger rail and agricultural shipments. Farmers from the Midwest to Washington State have faced what they call “unprecedented” delays in moving Wheat and other products to West Coast ports. Amtrak service through fossil-fuel train corridors has also suffered significant disruption and officials have expressed concern that the problem will only get worse as more terminals come online.

“Railroads can be part of the solution, transporting crops and people or part of the problem with coal and oil. We should make that decision, not the fossil fuel companies,” Said Patrick Mazza, a longtime climate activist also locked to the tracks.

Mazza says he is taking this action for his daughter who will turn 18 tomorrow.

“My last act as a father before my daughter reaches full adulthood tomorrow is to put my body on the line today,” Said Mazza, “It is up to us of the parental generation to do our absolute best to leave the least climate disrupted world we can, to put our bodies on the line to give our kids a fighting chance to deal with what we have left them.”

Development of extreme energy projects like the Alberta Tar Sands, Bakken Shale Oil and coal from the Powder River Basin, has fueled an explosion in proposed fossil fuel infrastructure in the Northwest. More than twenty new or expanded coal, oil and gas terminals are proposed between British Columbia, Washington and Oregon. In both states and British Columbia these proposals have been met with fierce local resistance. Local communities have challenged both the safety of transporting coal, oil and volatile gas through their communities and the role of fossil fuel export in fueling catastrophic climate disruption. Proposed coal terminals in Longview and Bellingham or oil terminals in Vancouver and Gray’s Harbor, would lead to more carbon emissions than produced in the state of Washington each year.

“We could pass every climate initiative proposed by Governor Inslee, but if we let these terminals be built our future is on the chopping block,” said Liz Spoerri a Seattle middle school teacher also locked on the tracks.

While proposed coal and oil terminals have been controversial for years, climate activists in the Northwest have significantly intensified their tactics this summer. In Montana, residents sat on the tracks to block a coal train last April, and again on August 16th. In early July a woman locked herself to a 55-gallon barrel filled with concrete, blocking oil-trains at a Portland facility. In a similar action on July 28th three people blocked oil-trains at the Tesoro refinery in Anacortes by locking themselves to concrete filled barrels. Most recently three Seattle residents, including state legislative candidate Jess Spear, were arrested blocking oil and coal trains near the Seattle Waterfront.

“People in the Northwest are not going to allow this region to become a fossil fuel superhighway,” said Mike LaPoint, an Everett small business owner locked on the tracks. “This is just a sample of the resistance that will happen if any large fossil fuel project is permitted.”

Despite controversy the number of fossil fuel trains on Washington’s rails continues to rise. While larger coal and oil terminals are undergoing lengthy environmental reviews, projects at Washington’s refineries have brought approximately two oil-trains per day to communities like Seattle and Everett. While the Department of Ecology conducts a study on the safety of oil-by-rail construction continues on a new terminal at the Phillips 66 refinery in Ferndale, and local officials are attempting to fast-track an oil-train terminal at Shell’s Puget Sound Refinery, without environmental review. Each of these projects could add up to six oil-trains per week to the rails. Expansions at the Fraser Surrey Docks coal export facility in Vancouver, Canada would increase the number of coal trains moving through Washington. Activists are demanding an immediate moratorium on all new fossil fuel terminals.

“Politicians play a blame game and talk about safety, but new terminals keep getting rubber stamped and built,” said LaPoint, “If elected officials won’t stop the fossil fuel takeover, we’ll have to do it for them.”

Rising Tide North America is part of the global movement against climate chaos and for social and environmental justice. We believe climate change can only be addressed by exposing the intersections between the oppressions of humans and the earth. No effort to create a livable future will succeed without the empowerment of marginalized communities and the dismantling of the systems of oppression that keep us divided.

As such, we condemn the Israeli military’s attacks on the Palestinian people in Gaza and the occupation of the West Bank. We reject any attempt to isolate the attacks on the Palestinian people and the occupation of the West Bank and Gaza from the intersectional global fight for climate justice. As the broad-based climate movement prepares to march in New York City, we call upon other groups and organizations committed to fighting the climate crisis to condemn publicly the Israeli military’s assault on Palestine.

In New York City, we will march with communities and groups who are working daily for community resilience against climate events like Superstorm Sandy and for food and environmental justice. We believe that from Palestine to New York City and beyond, our struggles for climate and social justice are all related.

In the movement for environmental and climate justice, we stand with those around the globe fighting war and occupation. Rising Tide North America is committed to opposing land grabs and resource exploitation by industries and state-sanctioned institutions. One of those institutions has been, and continues to be, imperial militaries which destroy communities, the environment, and the climate.

Militaries exploit land and natural resources to fuel their violent control and power over others. The unfettered burning of fossil fuels by militaries to wage war and violence on communities is exacerbating climate change and the impacts of droughts, extreme weather events, flooding, and sea level rise. This will lead to an increase in forced displacement and the number of climate refugees hoping to seek access to food, water, and homes elsewhere.

We recognize and reject that the United States financially and materially supports the Israeli military and countless other land grabs. As North American-based activists fighting against climate change, it is necessary to connect the colonization, capitalism and imperialism of our state and others with our daily work. The Israeli military’s actions actively support the corporations whose profits depend on the control and exploitation of land. As many regions of the world have so called ‘valuable’ natural resources, including the occupied Palestinian territories, we extend our solidarity with all who are impacted by resource extraction processes, and encroachments on their sovereignty and self-determination.

We recognize that the struggle to protect the land, water, and air from colonization, capitalism, and imperialism is a struggle that the people of Palestine face everyday. We extend our voices of solidarity to the people of Palestine who are facing unacceptable escalation of violence as they struggle to end the illegal occupation of their land.
